1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your use of the Road2Haramain website, the Road2Haramain mobile app (when launched), and the related services operated by M1 Merchant Sdn Bhd. The wallet, e-money and payment services behind Road2Haramain are operated by MobilityOne Sdn Bhd through the MiPAY platform under separate MiPAY terms.
By accessing or using Road2Haramain, registering an account, or completing eKYC, you agree to be bound by these Terms and by the MiPAY wallet terms made available to you within the app. If you do not agree, you must not use the services.
2. Eligibility and Account Registration
To use Road2Haramain you must be at least 18 years old, legally competent to enter into a contract in your jurisdiction, and not otherwise restricted from using e-money or payment services under applicable law. You agree to provide accurate, current and complete information during registration and eKYC, and to keep that information up to date.
You are responsible for safeguarding your account credentials, device security and any authentication factors issued to you, including OTPs, PINs and biometric data. You must notify us promptly of any unauthorised use of your account.
3. The Road2Haramain Wallet and Payment Services
The Road2Haramain wallet is a branded e-money account operated under the MiPAY platform by MobilityOne. Wallet balances, transactions, QR payments, DuitNow (where supported), P2P transfers, cash-out, and any optional prepaid card programme are subject to:
- The MiPAY wallet terms and programme rules provided to you in-app.
- Applicable regulatory limits, scheme rules and transaction monitoring.
- Successful completion of eKYC, sanctions screening and ongoing risk checks.
M1 Merchant does not hold customer funds. All funds movement, settlement and safeguarding is performed by MobilityOne within the MiPAY platform framework.
4. Partner Services
Road2Haramain connects you with a curated set of partner services spanning accommodation, travel, health, learning and protection. Each partner is responsible for the products and services it provides, including pricing, availability, quality, fulfilment, warranty and specialist support.
When you choose to use a partner service through Road2Haramain, additional terms from that partner may apply and will be presented to you before you complete the relevant transaction. M1 Merchant is not a party to the contract between you and the partner, except where expressly stated.
5. Fees and Charges
Unless otherwise stated, use of the Road2Haramain app and the basic MiPAY wallet services is provided at the fee structure described in the app and on the relevant MiPAY terms. Specific services — including certain payment methods, eKYC, OTP usage, prepaid card issuance, customisation and partner-service transactions — may attract fees that will be disclosed to you before you incur them.
6. User Obligations and Acceptable Use
You agree to use Road2Haramain only for lawful purposes and in accordance with these Terms. You must not:
- Provide false, misleading or fraudulent information during eKYC or otherwise.
- Use the wallet or partner services for money laundering, terrorism financing, sanctions evasion, fraud or any other illegal activity.
- Attempt to gain unauthorised access to any part of the platform, another user’s account, or any underlying systems.
- Reverse-engineer, decompile or otherwise attempt to derive source code from the app or platform, except as permitted by law.
- Use Road2Haramain in any manner that could damage, disable, overburden or impair the platform or interfere with other users.
7. Intellectual Property
The Road2Haramain brand, name, logo, app design, content and related materials are owned by M1 Merchant Sdn Bhd or its licensors. The MiPAY platform and wallet technology are owned by MobilityOne Sdn Bhd. You may not use these marks or materials except as permitted by these Terms or with our prior written consent.
8. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, Road2Haramain and the related services are provided on an “as is” and “as available” basis. M1 Merchant Sdn Bhd and MobilityOne Sdn Bhd make no warranties, express or implied, regarding the services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, neither M1 Merchant Sdn Bhd nor MobilityOne Sdn Bhd will be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or goodwill, arising from or related to your use of Road2Haramain. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for fraud, death or personal injury caused by negligence).
9. Indemnification
You agree to indemnify and hold harmless M1 Merchant Sdn Bhd, MobilityOne Sdn Bhd, and their respective officers, employees and agents, from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the services, or your violation of any applicable law or third-party right.
10. Suspension and Termination
We may suspend or terminate your access to Road2Haramain or any related service at any time if we reasonably believe that you have breached these Terms, that your account is being used for fraudulent or illegal activity, that continued access poses a security or regulatory risk, or where required by law or by MobilityOne / MiPAY.
You may close your Road2Haramain account at any time by following the in-app instructions, subject to the settlement of any outstanding transactions and applicable law.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless applicable consumer law provides otherwise.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the latest changes took effect. Material changes will be communicated through the app or website where appropriate. Continued use of Road2Haramain after the effective date constitutes acceptance of the updated Terms.
